What do you need to know about the victim personal statement?
The Victim Personal Statement (VPS) gives victims the opportunity to explain how the crime affected them and their family, and what the impact of release will be. More information about the Victim Contact Scheme and VPS.
When to make a victim statement in Scotland?
If inspectors are asked about making a victim statement during the investigation, the victim should be informed that they will be invited to make a statement by the Procurator Fiscal once a decision has been made to take the relevant case to trial. Can a victim request a copy of their VPS?
Greater flexibility over when and how a Victim Personal Statement (VPS), which tells the court how the crime has affected the victim, can be made – recognising that for many the impact of the crime may not be immediately apparent. Victims will also be able to request a copy of their VPS for them to refer to in future.
When did the victim statement scheme come into force?
3 The Victim Statement Scheme, the equivalent scheme in Scotland, came into force on 1 April 2009. The scheme is only available to victims whose cases are heard in the High Court or in cases where a Sheriff sits with a jury (courts of solemn jurisdiction).
